  12. There are two non-registered versions of F/WIN Anti-Virus. The
  13. "SHAREWARE VERSION" is the version that may be freely copied and
  14. used on a trial basis for thirty days.  Some of its features are
  15. disabled until a valid registration key file is used with it.
  16.  
  17. The "EVALUATION VERSION" is a fully-functional version of F/WIN
  18. Anti-Virus that expires on a certain date.  You may receive a
  19. copy of this version only directly from Stefan Kurtzhals, or an
  20. authorized F/WIN Anti-Virus distributor.  The EVALUATION version
  21. may NOT be copied or given to third parties without the written
  22. permission of Stefan Kurtzhals or an authorized F/WIN Anti-Virus
  23. distributor.  You are not allowed to distribute the EVALUATION
  24. version of F/WIN on BBSes or other online services.

  28. I.   FOR "SHAREWARE VERSION" OF F/WIN ANTI-VIRUS
  29. =================================================================
  30.  
  31. NOTICE TO USERS: CAREFULLY READ THE FOLLOWING LEGAL AGREEMENT.
  32. USE OF THE SOFTWARE PROVIDED WITH THIS AGREEMENT (THE "SOFTWARE")
  33. CONSTITUTES YOUR ACCEPTANCE OF THESE TERMS. IF YOU DO NOT AGREE
  34. TO THE TERMS OF THIS AGREEMENT, PROMPTLY REMOVE THE SOFTWARE
  35. TOGETHER WITH ALL COPIES FROM YOUR COMPUTER AND, FLOPPY
  36. DISKETTES.  USER'S USE OF THIS SOFTWARE IS CONDITIONED UPON
  37. COMPLIANCE BY USER WITH THE TERMS OF THIS AGREEMENT. THE SOFTWARE
  38. MAY BE EVALUATED FOR THIRTY DAYS ON A ROYALTY FREE BASIS.
  39. CONTINUED USE AFTER EVALUATION IS CONDITIONED UPON PAYMENT BY
  40. USER OF THE REGISTRATION FEE SPECIFIED IN THE FILE ORDER.TXT.

  43. The F/WIN Anti-Virus executable file (FWIN.EXE) and the
  44. accompanying files are SHAREWARE. You are hereby granted a
  45. license by Stefan Kurtzhals, owner and author of F/WIN Anti-Virus
  46. to evaluate and distribute the SHAREWARE copy of the software
  47. and its accompanying files, under the following conditions:
  48.  
  49. 1.   Using the F/WIN Anti-Virus means that you agree to all of
  50.      the conditions stated in this agreement.
  51.  
  52. 2.   Stefan Kurtzhals and authorized distributors of F/WIN Anti-
  53.      Virus can never be held responsible for damage, directly or
  54.      indirectly resulting from the use of the F/WIN Anti-Virus
  55.      product, or through following the instructions in the F/WIN
  56.      Anti-Virus documentation.
  57.  
  58. 3.   The SHAREWARE version package of the F/WIN Anti-Virus may
  59.      not be sold or licensed. Neither may a fee be charged for
  60.      its use.  If a fee is charged in connection with the F/WIN
  61.      Anti-Virus utilities at all, it should only cover the cost
  62.      of copying or distribution. UNDER NO CIRCUMSTANCES should
  63.      payment of such fees be understood to constitute legal
  64.      ownership.
  65.  
  66. 4.   The F/WIN Anti-Virus shareware package must be presented in
  67.      its complete form. Distributing the program and its
  68.      accompanying files separately is strictly forbidden.
  69.  
  70. 5.   None of the files within the F/WIN Anti-Virus SHAREWARE
  71.      package may be modified or altered in any way.
  72.  
  73. 6.   By granting you the right to distribute the SHAREWARE copy
  74.      of the F/WIN Anti-Virus, you do not become the owner of the
  75.      product in any way.
  76.  
  77. 7.   The SHAREWARE version package of the F/WIN Anti-Virus may be
  78.      distributed freely without charge.
  79.  
  80. 8.   Stefan Kurtzhals and all authorized distributors of F/WIN
  81.      Anti-virus accept no responsibility in the event that F/WIN
  82.      malfunctions or does not function at all.
  83.  
  84. 9.   Any other use, distribution or representation of the F/WIN
  85.      Anti-Virus utilities is forbidden without the written
  86.      permission of Stefan Kurtzhals, author and owner of F/WIN
  87.      Anti-Virus.
  88.  
  89. 10.  You agree that you will not attempt to reverse compile,
  90.      modify, translate, or disassemble the F/WIN Anti-Virus
  91.      software in whole or in part.
  92.  
  93. 11.  If F/WIN Anti-Virus does not conform to the limited warranty
  94.      in the "DISCLAIMER OF WARRANTY AND LIMITED WARRANTY" section
  95.      below, Stefan Kurtzhals's and F/WIN's authorized
  96.      distributors's entire liability and your sole remedy shall
  97.      be, at Stefan Kurtzhals's option, either to (a) correct the
  98.      error or (b) help you work around or avoid the error. The
  99.      Limited Warranty is void if failure of the F/WIN Anti-Virus
  100.      has resulted from accident, abuse, or misapplication. Any
  101.      replacement software will be warranted for the remainder of
  102.      the original Limited Warranty period.
  103.  
  104. 12.  STEFAN KURTZHALS AND AUTHORIZED DISTRIBUTORS FOR F/WIN ANTI-
  105.      VIRUS DOES NOT WARRANT THAT THE SOFTWARE IS ERROR FREE.
  106.      EXCEPT FOR THE EXPRESS LIMITED WARRANTY IN SECTION
  107.      "DISCLAIMER OF WARRANTY AND LIMITED WARRANTY" BELOW, STEFAN
  108.      KURTZHALS AND AUTHORIZED DISTRIBUTORS OF F/WIN ANTI-VIRUS
  109.      DISCLAIMS ALL OTHER WARRANTIES WITH RESPECT TO THE F/WIN
  110.      ANTI-VIRUS SOFTWARE, EITHER EXPRESS OR IMPLIED, INCLUDING
  111.      BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY,
  112.      FITNESS FOR A PARTICULAR PURPOSE AND NONINFRINGEMENT OF
  113.      THIRD PARTY RIGHTS.  SOME JURISDICTIONS DO NOT ALLOW THE
  114.      EXCLUSION OF IMPLIED WARRANTIES OR LIMITATIONS ON HOW LONG
  115.      AN IMPLIED WARRANTY MAY LAST, OR THE EXCLUSION OR LIMITATION
  116.      OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE
  117.      LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU.  THIS
  118.      WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS AND YOU MAY ALSO
  119.      HAVE OTHER RIGHTS WHICH VARY FROM JURISDICTION TO
  120.      JURISDICTION.

  122. 13.  In the event of invalidity of any provision of this
  123.      license, the parties agree that such invalidity shall not
  124.      affect the validity of the remaining portions of this
  125.      license.

  127. 14.  IN NO EVENT SHALL STEFAN KURTZHALS, F/WIN'S AUTHORIZED
  128.      DEALERS OR ITS SUPPLIERS BE LIABLE TO YOU FOR ANY
  129.      CONSEQUENTIAL, SPECIAL, INCIDENTAL OR INDIRECT DAMAGES OF
  130.      ANY KIND ARISING OUT OF THE DELIVERY, PERFORMANCE OR USE OF
  131.      THE SOFTWARE, EVEN IF STEFAN KURTZHALS, F/WIN'S AUTHORIZED
  132.      DEALERS AND SUPPLIERS HAVE BEEN ADVISED OF THE POSSIBILITY
  133.      OF SUCH DAMAGES. IN NO EVENT WILL STEFAN KURTZHALS, F/WIN'S
  134.      AUTHORIZED DEALERS OR ITS SUPPLIERS LIABILITY FOR ANY CLAIM,
  135.      WHETHER IN CONTRACT, TORT OR ANY OTHER THEORY OF LIABILITY,
  136.      EXCEED THE LICENSE FEE PAID BY YOU, IF ANY.
  137.  
  138. 15.  This license will be governed by the laws of the State of
  139.      Ohio as they are applied to agreements between Ohio
  140.      residents entered into and to be performed entirely within
  141.      Ohio. The United Nations Convention on Contracts for the
  142.      International Sale of Goods is specifically disclaimed.
  143.  
  144. 16.  This is the entire agreement between you and Stefan
  145.      Kurtzhals, which supersedes any prior agreement or
  146.      understanding, whether written or oral, relating to the
  147.      subject matter of this license.
  148.  
  149. 17.  F/WIN Anti-Virus may not be bundled or included with any
  150.      hardware or software without the expressed written consent
  151.      of Stefan Kurtzhals, or an F/WIN Anti-Virus authorized
  152.      distributor.
  153.  
  154. 18.  User agrees to pay all legal costs for the plaintiff,
  155.      Stefan Kurtzhals, if litigation is undertaken to deal with
  156.      user's illegal distribution of F/WIN Anti-Virus software
  157.      and/or key file(s).
  158.  
  159. 19.  If the SHAREWARE version has been converted to a
  160.      fully-functional registered version through the purchase
  161.      of a key file (FWIN.KEY), it is forbidden to knowingly
  162.      give away for free, or to sell the FWIN.KEY file.  Ownership
  163.      of all the executable and documentation files may be
  164.      TRANSFERRED in whole (but not in part) to another owner,
  165.      but the FWIN.KEY file may NOT be transferred to any third
  166.      party under any circumstances.  User agrees to only
  167.      use a key file (FWIN.KEY) that was LEGALLY obtained.
  168.      "TRANSFERRED" means that the original legal owner gives
  169.      away, or sells all of the F/WIN Anti-Virus files (except
  170.      the FWIN.KEY file), and said owner no longer possesses
  171.      any copies of those files on any magnetic medium such as
  172.      diskettes, hard drives, backup tapes, or any other
  173.      storage medium.

  181. II.   FOR THE "EVALUATION VERSION" OF F/WIN ANTI-VIRUS

  287.      Stefan Kurtzhals, if litigation is undertaken to deal with
  288.      user's illegal distribution of F/WIN Anti-Virus software or
  289.      key file(s).

  291. 15.  It is forbidden to knowingly give away for free, or to sell
  292.      the FWIN.KEY file that accompanied your EVALUATION copy of
  293.      F/WIN Anti-Virus.

  299. III.  REGISTRATION
  300. =================================================================
  301.  
  302. F/WIN is not free software!  You may evaluate this product, but
  303. if you decide to make use of it beyond the expiration date, you
  304. must register your copy.
  305.  
  306. For more information on how to register F/WIN Anti-Virus, see the
  307. enclosed ORDER.DOC file.
  308.  
  309. Registered users of F/WIN Anti-Virus enjoy the following extra
  310. benefits:
  311.  
  312. 1.   The macro virus cleaning facility will be active for all
  313.      file names, not just NORMAL.DOT as is the case in the
  314.      SHAREWARE version.
  315.  
  316. 2.   The /PARANOID feature is activated, allowing for more in-
  317.      depth scans for Microsoft Word macro viruses.
  318.  
  319. 3.   The /REPORT= feature is activated, allowing the user to
  320.      generate reports to disk of what F/WIN finds during its
  321.      scan.  This also allows for use of the /CLEANALL and
  322.      /WIPEALL features (they can't be used without /REPORT=).
  323.  
  324. 4.   While both registered and unregistered users of F/WIN will
  325.      receive customer support, registered users receive priority.
  326.  
  327. 5.   Future releases of F/WIN Anti-Virus may be downloaded from
  328.      various FTP and WWW sites on the internet.  Registered users
  329.      will have immediate access to all the latest features and
  330.      enhancements.
  331.  
  332. By using a legal Registered Version of F/WIN Anti-Virus, user
  333. agrees that it is forbidden to knowingly give away for free,
  334. or to sell the FWIN.KEY file.  Transfer of the FWIN.KEY file
  335. to any third party is forbidden.  Ownership of all the executable
  336. and documentation files may be TRANSFERRED in whole (but not
  337. in part) to another owner, but the FWIN.KEY file may NOT be
  338. transferred to any third party under any circumstances.  User
  339. agrees to only use a key file (FWIN.KEY) that was LEGALLY
  340. obtained. "TRANSFERRED" means that the original legal owner
  341. gives away, or sells all of the F/WIN Anti-Virus files (except
  342. the FWIN.KEY file), and said owner no longer possesses any
  343. copies of those files on any magnetic medium such as diskettes,
  344. hard drives, backup tapes, or any other storage medium.

  347.  
  348.                     THE REGISTRATION KEY FILE
  349.                     =========================
  350.  
  351. Registered users receive a registration key file called
  352. FWIN.KEY. The key file will contain important information
  353. such as the license number and the name of the license owner.
  354.  
  355. The key file FWIN.KEY is NOT to be sold or transferred in any
  356. way.  The F/WIN Anti-Virus program searches for the key file
  357. in the same directory where the program file itself resides.
  358.  
  359. If the key file is corrupt or invalid, the F/WIN Anti-Virus
  360. will continue without producing an error message.  However,
  361. F/WIN Anti-Virus will then turn into the normal unregistered
  362. SHAREWARE version.
  363.  
  364. Although you are allowed to use the SHAREWARE F/WIN Anti-Virus
  365. product for a period of 30 days, it is ILLEGAL to use it in
  366. combination with a key, produced without authorization of Stefan
  367. Kurtzhals or an authorized F/WIN Anti-Virus distributor.  It is
  368. also ILLEGAL to use a key generated by any software not
  369. distributed by Stefan Kurtzhals or an authorized F/WIN Anti-Virus
  370. distributor.
  371.  
  372. The FWIN.KEY file you obtained with a paid order entitles the
  373. user to legally download updates and use them with no time limits.
  374. The payment for the registered version is a one-time charge that
  375. will not have to be paid ever again for the DOS version of
  376. F/WIN Anti-virus.
  377.  
  378. Stefan Kurtzhals reserves the right to modify F/WIN Anti-Virus,
  379. without notice to users, to no longer use existing FWIN.KEY
  380. files.  In such cases, owners of F/WIN Anti-Virus would need to
  381. specify the serial number of their existing FWIN.KEY file before
  382. they would be issued a new FWIN.KEY file.  A database will be
  383. used to track FWIN.KEY file owners to help assure that only
  384. owners of legal key files are given the new versions.
  385.

  387.  
  388.            DISCLAIMER OF WARRANTY AND LIMITED WARRANTY
  389.            ===========================================
  390.  
  391. The author of F/WIN warrants that:
  392.  
  393. (a)  the software will perform substantially in accordance with
  394.      the accompanying written materials and
  395.  
  396. (b)  the software is properly recorded on the disk media. This
  397.      warranty extends for thirty (30) days) from the date of
  398.      purchase.
  399.  
  400. There is no warranty after expiration of the warranty period.
  401.  
  402. Neither Stefan Kurtzhals nor anyone else who has been involved in
  403. the creation, production or delivery of the F/WIN Anti-Virus
  404. product and its accompanying files grants any other warranties
  405. with respect to the contents of the software, the written
  406. materials and each specifically disclaims any implied warranties
  407. of merchantability or fitness for any purpose.
  408.  
  409. Except as stated herein, in no event shall Stefan Kurtzhals or
  410. his suppliers or authorized distributors be liable for any
  411. damages whatsoever, whether direct, indirect, consequential, or
  412. incidental damages (including damages for loss of business
  413. profits, business interruption, loss of business information, or
  414. other pecuniary loss, arising out of the use of or inability to
  415. use such product even if Stefan Kurtzhals, his suppliers or
  416. authorized distributors have been advised of the possibility of
  417. such damages. Because some states do not allow the exclusion of
  418. limitation of liability for consequential or incidental damages,
  419. the above limitation may not apply to you.

  421. Stefan Kurtzhals reserves the right to revise the software and
  422. the written materials and to make changes from time to time in
  423. the contents without obligation to notify any person.

  430. All F/WIN Anti-Virus utilities are copyright 1996, Stefan
  431. Kurtzhals. All rights reserved.
  432.  
  433. The F/WIN Anti-Virus package is protected by copyright law,
  434. which applies to the computer software as well, except for that
  435. you may make copies of the software solely for backup or archive
  436. purposes and transfer the software to hard disk provided that the
  437. software is used as specified herein.
  438.  
  439. Making copies of the REGISTERED version of F/WIN Anti-Virus
  440. are also permitted for the purpose of distributing
  441. legal copies of F/WIN Anti-Virus throughout user's organization.
  442. For instance, if user ordered a just one diskette, but was
  443. licensed to use F/WIN Anti-Virus on 50 PC's, up to 50 copies
